1. OUR PRODUCTS
1.1 We make every effort to ensure that product colours, designs and descriptions are as accurate as possible on the website. However, due to constraints of digital reproduction, we cannot guarantee exact depiction and variations may occur.
1.2 It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations please contact us.
2. ORDERING FROM HOPSCOTCH
2.1 Payment for all orders is made at the point of sale, and not at the point of dispatch.
2.2 By making a purchase, you specifically authorise Hopscotch to submit information to PayPal or Stripe for authorisation.
2.3 If your PayPal or Stripe declines authorisation for any reason, Hopscotch cannot be held liable for any delay in dispatch or non-delivery.
2.4 All payments are processed and authorised by PayPal or Stripe (for credit or debit card payments).
2.5 All sensitive credit or debit card data entered at checkout is processed and saved on Stripe’s secure servers.
2.6 When you register for a Hopscotch account on the My Account section of the website, or during checkout, and pay using a credit or debit card, your payment card details will be automatically saved on Stripe’s secure servers for faster checkout in the future. No sensitive data is transferred to or stored on our website or on our servers. You can view, edit or delete your stored payment card information at any time by accessing the My Account page on our website.
3.1 Our products can be delivered to any country listed in the shipping section of the checkout page of our website.
3.2 Delivery options and charges are shown at cart when you select the destination country from the dropdown list.
3.3 We reserve the right to cancel your order due to postage restrictions imposed on us by Royal Mail or other delivery provider used.
3.4 Most orders are delivered by Royal Mail, but sometimes we have to use alternative delivery companies. Proof of delivery is not usually obtained and a signature is not usually required upon delivery.
3.5 You can find estimated delivery times on our Delivery + Returns page, but actual delivery times may vary for you depending on:
– our stock availability;
– your delivery address;
– problems or delays processing your payment; and
– circumstances impacting delivery by the postal service.
3.6 We reserve the right to use alternative delivery methods without prior notification. Alternative delivery methods may require a signature upon delivery.
3.7 You will not hold us responsible for any delays, outside our control, which relate to the delivery of orders.
3.8 We cannot accept a claim for loss unless at least 10 working days for items posted to the UK, 20 working days for items posted to Europe, or 25 working days for items to the rest of the world have passed from the due delivery date.
3.9 It is your responsibility to report all lost or undelivered boxes in writing by email to email@example.com within 30 working days of the expected day of delivery.
3.10 In the unlikely event your order is lost or undelivered, we reserve the right to either send you a replacement order, or issue a refund using the same payment method you originally used.
3.11 If your order does not fit through your letterbox and you are out when it is delivered, Royal Mail or an alternative delivery company should leave a card at the address with information about collection or re-delivery. The postage provider will hold the box for 18 days before returning it to us and it is your responsibility to contact them to arrange receipt of the box as soon as you can. We cannot be held responsible for refunding or replacing the box if this process has not been followed. Once you have received a card with information about collection or re-delivery, it is solely your responsibility to arrange to receive your delivery.
3.12 It is your responsibility to ensure your delivery address is accurate and correct at the time of order. If an error is made Hopscotch will not refund or credit for any orders delivered to the wrong location.
3.13 We reserve the right to cancel your order if it becomes apparent that, in our sole opinion, the postal service in your area is too unreliable. Nothing in this section affects your legal rights.
4.1 We endeavour to dispatch all orders within 2 working days from when your order is placed and the payment is received.
4.2 You may cancel your contract with Hopscotch and return an item(s) to us for a full refund (minus the original delivery costs), within 30 days of receiving your order.
4.2.1 To cancel your order you must notify us in writing by email to firstname.lastname@example.org quoting your name and order reference number. Below you can find a sample cancellation form that you can copy and use to contact us:

4.2.2 In the event of an order cancellation on your part (a return within 30 days), you are required to cover the cost of returning the item(s) to Hopscotch. We cannot reimburse you for this cost unless the item is faulty or has been damaged in transit.
4.2.3 In the unlikely case your order is faulty or has been damaged in transit, please contact us at your earliest opportunity by emailing firstname.lastname@example.org. We will either replace the damaged item and dispatch it free of charge within 2 working days, or refund the price you paid for the item including postage.
4.2.4 We reserve the right to require proof of damage: You can either photograph the damage and email it to us at email@example.com, or return the item to our postal address (which we will supply to you). If the item is found to be faulty or damaged, we will refund the price you paid for it, and reimburse you for the returns postage. If the item is found not to be faulty or damaged, we cannot refund you for the item, or reimburse you for the return postage costs.
4.2.5 Once an item has been dispatched, we’re not able to accept returns or exchanges for items that have been personalised or made to order, or pierced jewellery (for reasons of hygiene), unless that item has been damaged in transit or is found to be faulty.
4.3 In the event of a cancellation, we will reimburse you without undue delay and within 14 days from the day we receive the returned items or, if earlier, 14 days from the day we receive a proof of postage of your returned order from you. We will reimburse you using the same payment method you used originally.
4.4 Hopscotch reserve the right to cancel the contract between the customer, in an unlikely case, if:
– we have insufficient stock to deliver the goods you have ordered;
– we are not able to deliver to your area; or
– one or more of the products you have ordered has a pricing, description or technical issue.
5. WITHDRAWAL OF PRODUCTS
5.1 We reserve the right to remove or edit any products, materials, content or prices online at any time. We may refuse to process a transaction for any reason at our sole discretion.
6. SUBSCRIPTION PRODUCTS (HOPSCOTCH BOX & HOPSCOTCH BOX +)
Purchase of subscription products
6.1 When you checkout for a subscription box (Hopscotch Box or Hopscotch Box +) on our website you will automatically be signed up to receive a regular delivery of our subscription products once per month. You can manage and make changes to your orders at any time. Please see our Subscription Box FAQs for more details.
6.1.2 You may submit orders online at any time after you have created an account. The website allows you to review your order and make any corrections at checkout before submitting it to us and by submitting the order you confirm that you have made any such corrections. Our website allows you to view all the boxes you have already ordered from us, and you can do this by clicking visiting the ‘My Account’ section.
6.1.3 Your submission of an order amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order except as specifically stated in these Terms and Conditions.
6.1.4 No order is accepted from you until our website displays an order confirmation message. This message is displayed once your credit or debit card payment has been authorised by Stripe, or you are automatically redirected to our website after your PayPal payment is complete. You will also receive an email confirmation to this effect.
6.1.5 We select the contents of your boxes each month. Not all monthly boxes will be the same for all subscribers.
Subscription product payments
6.2 The price of subscription products is as quoted on the website.
6.2.2 We take payments by continuous payment authority.
6.2.3 All credit and debit card payments are authorised by Stripe. All sensitive card data is saved on Stripe’s secure servers to allow safe recurring payments each month. You can view, delete, or change your saved payment card at any time by viewing the My Account section of the website.
6.2.4 You can also purchase a subscription product using PayPal, with payments processed according to their terms and conditions as you agree to by authorising payment on their website during checkout.
6.2.5 When clicking the final submission button at checkout on our website for debit and credit card payments, or on the PayPal website you are directed to during checkout, you agree to give full authorisation to automatically take your subscription payment each month, until you suspend (pause) or cancel your subscription via the My Account section of the website.
6.2.6 When you start your subscription, we will take your first payment for your first box. Your subscription won’t start until this payment has been processed and cleared.
6.2.7 Your subscription will be renewed automatically each month, and your monthly payment will be taken on or around the same date of your first payment each month.
6.2.8 For customers who use PayPal for a subscription product, PayPal takes control of the schedule for charging recurring payments payments and batch processes payments, and this means that they do not process payments exactly when they are due. Instead, PayPal will process a payment within 24 hours of when the payment is due. For example, if a recurring payment is due at 2pm on 1st July, PayPal may charge that payment anytime between 12:00am and 11:59pm on the 1st of July. Depending on your timezone, this may cause payment to be processed on a different day to the day you signed up. Bank holidays and other public holidays may also change the monthly payment date.
6.2.9 You agree not to hold us responsible for any and all banking charges incurred due to recurring payments on your account, payments processed by Stripe, or payments processed by PayPal.
6.2.10 Goods are subject to seasonal changes in supply levels and supply prices. We reserve the right to change the fees for any services at any time. We agree to notify you at least 30 days in advance of any change in fees. Please note that you can cancel at any time. Your monthly payment will not change without your express prior permission.
6.2.11 Upon registering, reactivating your account, restarting regular deliveries, or changing card details, a transaction may be processed by Stripe or PayPal to authorise or re-authorise it and prevent fraud. This transaction will either be for a zero value, or for a £1 payment which will be taken and then immediately voided. It is possible that Stripe or PayPal may temporarily register a £0 or £1 charge on your account balance.
6.2.12 Payments for our subscription products (Hopscotch Box and Hopscotch Box +) will be taken monthly, until you suspend (pause) or cancel your subscription via the My Account section of the website.
Subscription product delivery and returns
6.3 Our subscription products can be delivered to any country listed in the shipping section of the checkout page of our website.
6.3.2 Delivery of our subscription products within the UK is free.
6.3.3 Delivery of our subscription products outside the UK is charged at a rate shown at checkout. This delivery charge applies to each subscription product sent and will be charged every month alongside your Hopscotch Box or Hopscotch Box + renewal charge, until you suspend (pause) or cancel your subscription.
6.3.4 We reserve the right to cancel your subscription due to postage restrictions imposed on us by Royal Mail or other delivery provider used.
6.3.5 Subscription boxes are usually delivered by Royal Mail. Proof of delivery is not obtained and a signature is not normally required upon delivery. Actual delivery times may vary for you depending on:
– our stock availability;
– your delivery address;
– problems or delays processing your payment; and
– circumstances impacting delivery by the postal service.
6.3.6 We reserve the right to use alternative delivery methods without prior notification. Alternative delivery methods may require a signature upon delivery.
6.3.7 We dispatch subscription products (Hopscotch Box and Hopscotch Box +) on or around the 15th of each month. The actual dispatch date will vary each month and can be earlier or later than the 15th depending on:
– our stock availability;
– public holidays;
– order demand; and
– circumstances impacting delivery methods.
6.3.8 We dispatch all our subscription products at the same time each month, regardless of when you start your subscription. If you start your subscription before the 10th of the month, you will receive the current month’s subscription box. If you start your subscription after the 10th of the month, you will receive the next month’s subscription box.
6.3.9 You will not hold us responsible for any delays, outside our control, which relate to the delivery of subscription boxes.
6.3.10 We cannot accept a claim for loss unless at least 10 working days for items posted to the UK, 20 working days for items posted to Europe, or 25 working days for items to the rest of the world have passed from the due delivery date.

6.3.13 If your box does not fit through your letterbox and you are out when it is delivered, Royal Mail or an alternative delivery company should leave a card at the address with information about collection or re-delivery. The postage provider will hold the box for 18 days before returning it to us and it is your responsibility to contact them to arrange receipt of the box as soon as you can. We cannot be held responsible for refunding or replacing the box if this process has not been followed. Once you have received a card with information about collection or re-delivery, it is solely your responsibility to arrange to receive your delivery.
6.3.14 If you change address, you must update your address details in the relevant section of the website (within the My Account section of the website) to ensure that boxes are not sent out to the wrong address. Please ensure this is done in time to take effect (before your monthly payment is processed) before you move as you will not be refunded or credited for any boxes posted to the wrong location. We also recommend informing us of a change of address in writing to email@example.com.
6.3.15 We reserve the right to cancel your account and/or subscription with us if it becomes apparent that, in our sole opinion, the postal service in your area is too unreliable.
6.3.16 If you are dissatisfied with any product you receive from us, please contact firstname.lastname@example.org. We retain the right to request a return of any faulty goods to us and the product will be inspected. If the fault is agreed, a full refund will be given for the returned goods, including your return postage costs upon provision of a receipt. Nothing in this section affects your legal rights.
6.3.17 If you order any other products at the same time as your Hopscotch Box or Hopscotch Box +, all items will be dispatched at the same time as your first subscription box. If you require other products to arrive before this time, we recommend placing a separate order. All items within your order will be dispatched at the same time, and to the same postal address.
Subscription product cancellation
6.4 You can cancel the purchase of a subscription box at any time before the cut off time relevant to your renewal day. This is the day each month Stripe or PayPal processes and captures your monthly payment, and will vary on a month-to-month basis due to batch processing. As discussed in section 6.2.8, please be aware that there can be a 24 hour window from your renewal date when your payment can be processed and captured. Your renewal date will be within 24 hours of the date you started your subscription. For example, if a recurring payment is due at 2pm on 1st July, PayPal may charge that payment anytime between 12:00am and 11:59pm on the 1st of July. Depending on your timezone, this may cause payment to be processed on a different day to the day you signed up.
6.4.2 You will only be sent a subscription product once payment has been processed. This means that if you cancel your subscription before payment has been processed, you will not receive the next box.
6.4.3 You can cancel the purchase of your subscription by visiting your My Account page, viewing your subscription your subscription you want to cancel, selecting “cancel” and following the confirmation instructions.
6.4.4 Cancellation must be by the website www.hopscotchlondon.com. You remain responsible for ensuring that any such change or cancellation is not only transmitted by you, but received by us, in time for the deadline.
6.4.5 We reserve the right to terminate or restrict your use of our service, for any or no reason whatsoever. One reason that we may do so is if we believe that you are in breach of any obligation under these Terms and Conditions.
6.4.6 If we terminate your use of our service as a result of a breach of any obligation under these Terms and Conditions, such termination would be immediate and may be without notice.
7. COUPON CODES DISCLAIMER
7.1 Coupon codes issued can only be used until their expiry date.
7.2 The offer can only be used once against a purchase and coupon codes cannot be used in conjunction with any other promotional offer such as discount offers, products reduced in price, sample sale or seasonal sale.
7.3 Hopscotch reserves the right to remove coupon codes without warning due to insufficient stock, technical issues or misuse of a coupon code.
7.4 Coupon codes issued can only be used in conjunction with any specified terms and conditions of use.
7.5 Hopscotch reserves the right to change or alter specified terms and conditions of use at any time without prior notice.
7.6 Hopscotch reserves the right to cancel orders if Hopscotch finds a coupon code has been misused or used against the coupon code’s terms and conditions of use without prior notice.
9. INTELLECTUAL PROPERTY
9.1 By using this site, you acknowledge that all intellectual property rights in the goods supplied, including copyright, design rights and trademarks belong to Hopscotch or our suppliers.
9.2 All designs, text and images of Hopscotch’s products provided on the website are protected by copyright and may be reproduced only on websites which provide links to www.hopscotchlondon.com and where the material is clearly credited to Hopscotch, or otherwise only by the written permission of Hopscotch.
9.3 Hopscotch reserves the right to request any intellectual property, including but not limited to images, text, icons, videos and other media, be edited or removed when reproduced on other websites, printed or digital mediums.
10. LEGAL STATEMENT
10.1 Hopscotch’s total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Hopscotch to the customer.
10.2 Hopscotch shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or any other way.
10.3 Hopscotch cannot accept any liability for a failure to comply with specific instructions stated in the catalogue or on the product. Your statutory rights are not affected by this statement.
10.4 If any term of the Agreement is held to be illegal, invalid or unenforceable, in whole or in part, such part shall be deemed not to form part of the Agreement but the legality, validity or enforceability of the remainder of the Agreement shall not be affected.

11.1 We make every effort to use environmentally friendly and recycled packaging for our deliveries, however on occasion, to ensure the product reaches you in perfect condition we have to make exceptions.
